"AN ACT PENALIZING PERSONS DRIVING UNDER THE INFLUENCE OF ALCOHOL, DANGEROUS DRUGS, AND SIMILAR SUBSTANCES, AND FOR OTHER PURPOSES"

BACKGROUND/ SUMMARY

Pursuant to the Constitutional principle that recognizes the protection of life and property and the promotion of the general welfare as essential for the enjoyment of the blessing of democracy, it is hereby declared the policy of the State to ensure road safety through the observance of the citizenry of responsible and ethical driving standards. Towards this end, the State shall penalize the acts of driving under the influence of alcohol, dangerous drugs and other intoxicating substances and shall inculcate the standards of safe driving and the benefits that may be derived from it through institutional programs and appropriate public information strategies.

FLAWS 
The problem is, once again, in the implementing rules and regulations (IRR). I have been standing on my soapbox for over a year now trying to get the lay person to have a voice in how it should be implemented––because let’s face it, at the end of the day, it is we, the lay people, that will be ultimately affected––but typically, we were the only ones not consulted. 


WHAT NEEDS TO BE DONE
The Philippine National Police (PNP) and Department of Interior and Local Government (DILG) should provide a program for the continuous deputation of their personnel and the procurement of equipment (ABA) to support the implementation of R.A. No. 10586. 

The Department of Justice should assign and identify the prosecutors who shall handle cases of R.A. No. 10586 nationwide. 

Sustain monitoring, implementation and enforcement of the law and conduct a comprehensive review of the IRR for provisions that may need amendments.



IMPORTANCE

RA 10586 gives law enforcement officials the authority to conduct sobriety and breath alcohol tests on drivers. The DUI law also provides for mandatory testing on those involved in vehicular accidents to check if they were driving under the influence of alcohol or dangerous drugs.
